- Affidavit : A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Amendment : A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Answer : The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Assets : (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Beverage : means beer or other malt beverages, mineral waters, fruit juices, ades, and other similar noncarbonated drinks, soda water, and flavored carbonated drinks, in liquid form and intended for human consumption. See Hawaii Revised Statutes 339-1
- Charity : An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
- Commissioner of securities : means the commissioner of securities as defined in § 485A-102. See Hawaii Revised Statutes 484-1
- Common promotional plan : means a plan, undertaken by a single developer or group of developers acting in concert, to offer subdivided land for sale or lease; provided that where such land is offered for sale by the developer or group of developers acting in concert, and the land is contiguous or is known, designated, or advertised as a common unit or by a common name, the land shall be presumed, without regard to the number of lots covered by each individual offering, as being offered for sale or lease as part of a common promotional plan. - Contract : A legal written agreement that becomes binding when signed.
- Corporation : A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- county : includes the city and county of Honolulu. See Hawaii Revised Statutes 1-22
- Dead body : means lifeless human body, or such parts of the human body, or the bones thereof, from the state of which it reasonably may be concluded that death recently occurred. See Hawaii Revised Statutes 338-1
- Decedent : A deceased person.
- Deed : The legal instrument used to transfer title in real property from one person to another.
- Defendant : In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Department : means the department of health. See Hawaii Revised Statutes 339-1
- Director : means the director of the department of health. See Hawaii Revised Statutes 339-1
- Director : means the director of commerce and consumer affairs. See Hawaii Revised Statutes 484-1
- Discovery : Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Disposition : includes sale, lease, assignment, award by lottery, or any other transaction concerning a subdivision, if undertaken for gain or profit. See Hawaii Revised Statutes 484-1
- Escrow : Money given to a third party to be held for payment until certain conditions are met.
- Evidence : Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Extradition : The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
- Fraud : Intentional deception resulting in injury to another.
- Injunction : An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Jurisdiction : (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Lease : A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Lien : A claim against real or personal property in satisfaction of a debt.
- Litter : means rubbish, refuse, waste material, garbage, trash, offal, or any debris of whatever kind or description, whether or not it is of value, and includes improperly discarded paper, metal, plastic, glass, or solid waste. See Hawaii Revised Statutes 339-1
- Litter bag : means a bag, sack, or other container which is large enough to serve as a receptacle for litter. See Hawaii Revised Statutes 339-1
- Litter receptacle : means any container approved by the director and made available for the depositing of wastes. See Hawaii Revised Statutes 339-1
- Littering : means placing, throwing, or dropping litter on public or private property or in any public or private waters, except: (1) In a place which is designated by the department or the county for the disposal of garbage and refuse; (2) Into a litter receptacle; or (3) Into a litter bag, provided that the bag is disposed of properly into a litter receptacle or in a place designated by the department or the county for disposal of garbage and refuse. - Mortgage : The written agreement pledging property to a creditor as collateral for a loan.
- Obligation : An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Offer : includes every inducement, solicitation, or attempt to encourage a person to acquire an interest in land, if undertaken for gain or profit. See Hawaii Revised Statutes 484-1
- Partnership : A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person : means an individual, corporation, government, or governmental subdivision or agency, business trust, estate, trust, partnership, unincorporated association, two or more of any of the foregoing having a joint or common interest, or any other legal or commercial entity. See Hawaii Revised Statutes 484-1
- Plaintiff : The person who files the complaint in a civil lawsuit.
- Pleadings : Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
- Public offering statement : means a statement that fully and accurately discloses the physical characteristics of the subdivided lands offered and all unusual or material circumstances or features affecting the subdivided lands. See Hawaii Revised Statutes 484-1
- Public place : means any area that is used or held out for use by the public whether owned or operated by public or private interests. See Hawaii Revised Statutes 339-1
- Purchaser : means a person who acquires or attempts to acquire or succeeds to an interest in land. See Hawaii Revised Statutes 484-1
- Real property : Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Remainder : An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Rescission : The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- Service of process : The service of writs or summonses to the appropriate party.
- Statute : A law passed by a legislature.
- subdivided lands : means any land which is divided or is proposed to be divided for the purpose of disposition into two or more lots, parcels, units, or interests and also includes any land whether contiguous or not if two or more lots, parcels, units, or interests are offered as a part of a common promotional plan of advertising and sale. See Hawaii Revised Statutes 484-1
- Subdivider : means any owner of subdivided land who offers the land for disposition or the principal agent of an owner, who has been duly authorized in a writing filed with the director. See Hawaii Revised Statutes 484-1
- Subpoena : A command to a witness to appear and give testimony.
- Testimony : Evidence presented orally by witnesses during trials or before grand juries.
